>> um thanks very much chair um I just havea question about the independentperformance evaluation uh from arrow umwe've had a number of people try and getaccess to it by FOI and we've tried inthe Senate through an OPDum are you able to elaborate on why it'sexpected that the release of the reportwould cause damage in between therelations between Commonwealth and
Ms. Meg Brighton
>> Uh thanks Senator for the question. Sothe Australian government um uh onbehalf of all education ministerscommissioned that review um and in thatcapacity was all education ministers asthe company members of ERO. Um thatreport went to education ministers andconsistent with the conventions ofeducation ministersum ministers make a decision whetherthey will release the report or not umthe education ministers agreed not torelease the final report and I believeMinister Clare um also as part of theresponse to the order for the productionof documents uh referred to that asWell, um it's a matter of conventionthat release of any reports anddocuments have to have the agreement ofall education ministers. Uh so that's umuh that's the reason why it hasn't beenuh released. Um in terms of the FOIconsiderations, the FOI decision makershave regard to the various criteria thatgets applied to FOI uh decisions and oneof those criteria is about com staterelations and that points toparticularly the conventions ofeducation ministers meetings.
Senator Penny Allman-Payne
Um ERO's website says and I quote, "Wewelcome scrutiny to enhance theintegrity of our processes. Is refusingto release the report consistent with
Mr. Tony Cook
So Sandra, again it's probably not forArrow. Um the decision still doesn't sitwith them un in this circumstances. Thedecision sits with all educationministers. Uh the decision that's beenmade by that committee is that for thereport to not be released respons I getwhat you've made the point and I wouldabsolutely say they're up abouttransparency. This is an educationminister's meeting decision rather thana decision.
Senator Penny Allman-Payne
576 education academics, teachers, andschool leaders have signed an openletter calling for the report to bereleased. Do you recognize that there issubstantial interest from educators inthe release of this report and that notreleasing it actually reduces trust inwhy it hasn't been released? And becausethe assumption is being made that thosefindings uh must be poor particularlywhen one of the reasons for uh refusingthe FRRI was that it may damage umpeople's confidence in the organization.
Mr. Tony Cook
>> Um Senator certainly aware that there'sa lot of interest around it. Absolutely. And I take your point around that. Umagain and I'm I'm not trying to bedifficult. Um we can only operate withinthe education minister's um uhprotocols.um ministers have decided not to releasethe report. Um uh I I don't even knowwho or what ministers may have made interms of individual ministers, butthat's the decision that's been made bythe education ministers meeting as a

It just seems very inconsistent whenteachers around the country are underincredible scrutiny and continuallybeing told that they have to be held toaccount and we've got educationministers refusing to actually releasethe findings of what is supposed to bethe peak educational research body inthis country. I just find thatastounding. Uh but I guess we all willcontinue to lobby all of the stateministers to say that this is not okay.uh and teachers and educators deserve toknow what that review said because Idon't understand how people can beexpected to have confidence in them ifthe ministers don't want to tell us whatthat found. Um but I'll move on. Um myunderstanding isuh in response to an increase in sexualharassment and assault amongst highschool students, the minister announcedan independent evaluation of the CR REframework would commence later thisyear. Uh and I note that that frameworkwas only finalized uh earlier this year.Has an independent evaluator beenappointed and if not, how will they be
