Senator Andrew Bragg
>> So, was there a change in interpretationor change in practice in relation tothese these trusts?
Jeremy Hirschhorn
so Senatorhere so just sorry to help with thecontext of the question. the fact thatit became into the public domain as anissue in 2024. You're asking if that wasa result of a change in AT stance.
Senator Andrew Bragg
>> Yeah.
Jeremy Hirschhorn
>> Uh Senator, in short, it was not a itwas not as a result of a change in ATSstance.>> Okay. Um I I think what happened was>> uh that uh a couple of mattersuh which which came up during ordinaryreviews and auditsum came into the public domain.>> And uh caused many participants toreview their affairs.
Senator Andrew Bragg
>> Okay. Soum how much has been ra so these areeffectively historical mistakes thathave been made is that right?
Jeremy Hirschhorn
>> Um yes so if Ito give a bit of context so the therewere there have been various uhintegrity rules over time which havebeen introduced in relation to uh theabuse of trust for tax planningpurposes. the family trust electionregime was brought in as a regime forgenuine family trustsuh to effectively stay outside thoseintegrity regimes.
Senator Andrew Bragg
>> Yeah.
Jeremy Hirschhorn
>> Um to be unaffected by them. So the idea
Senator Andrew Bragg
was that they wouldn't be able to takelosses outside of the family
Jeremy Hirschhorn
>> as long as you start. So the idea wasthat as long as you you were genuinely asort of a solid family>> trust uh clustered around an anindividual and so there's there's aconcept of a sort of a core individual.Um what has happened over time is thatmy perspect well a perspective would bethat groups got more complex.>> Sometimes groups and their advisersforgot past electionsand did things which were contrary tothe contrary to the elected familygroup.>> Yeah. and triggered uh consequencesum and those consequences uh weredeliberately set at a harsh level tostop uh people abusing the family trustelection. What has become clear over thelast couple of years is that many familygroups and their advisers have donethings inconsistent with their familytrust elections have and havepotentially triggered those harshconsequences.
Senator Andrew Bragg
>> Yeah. And have have have any been
Jeremy Hirschhorn
>> Um, Senator, to the best of myknowledge, nobody has been bankrupted.
Senator Andrew Bragg
>> Okay. How much revenue has been raisedthrough these me these initiatives?
