Senator Raff Ciccone
>> All right, welcome back everyone.Hopefully you all had a nice break atdinner. Now, um Senator Canavan, did youwant to kick off more questions?
Senator Matthew Canavan
>> I just um wanted to go to um uh chapter18 then of um the free trade deal uh inparticular. I think uh section um 18.2 Ithink it was referred to earlier as umproviding some sort of flexibility to orfor uh the Australian government on itsuh net zero uh climate commitmentsarticle 18.2 I should say. [snorts]So is the is the position you putearlier that uh uh particularly clauseone there of 18.2 two lets each partydetermine its own domestic environmental
George Mina
>> Uh well, Senator, the words were uh leteach party establish determine itsustainable development policies, establish a level of of domestic andenvironmental labor protection it deemsappropriate and to adopt or modify itsrelevant law and policies in a mannerconsistent with this commitment. So>> [clears throat]>> uh this is a very clear and explicitexpression of the flexibility to whichwe were talking earlier. Senator,
Senator Matthew Canavan
>> well Mr. Manny, it didn't quite finishthat sentence there. It says consistentwith its commitments under the
George Mina
>> under the international agreementsstandards referred to in this chapter. That's right.
Senator Matthew Canavan
>> Yes. Can I just finish my question then?Uh so it reads consistent with itscommitments under the internationalagreements and labor standards referredto in this chapter. Mhm.>> Now later on in this chapterspecifically um 18.6uh each partyuh it says uh uh the commitment toeffectively implement the Parisagreement includes the obligation torefrain from any act or mission whichmaterially defeats the object andpurpose of the Paris agreement. And thenit goes on to say, in light of paragraphone, each party shall promote the mutualsupportiveness of trade and climatepolicies and measures that contribute tothe transition to a net zero and lowgreenhouse gas emissions, sustainablecircular economy, and climate resilientdevelopment. So read together that 18uh two get out of jail clause so tospeak does nothing of the sort becauseit it is restrained the government's ourgovernment's uh uh uh flexibility toadapt and modify its relevant law isrestrained by the commitments in thischapter which include include as I saidin 18.6 six uh measures that contributeto the transition of the economytransition of a net zero economy. Sorry.I on my very plain reading of that weare committed to net zero under this
George Mina
>> Well Senator that's uh not not correct.Uh if you are referencing article 18.6.4
Senator Matthew Canavan
>> I was reading from 18.63A. 63A>> each party shall promote the mutualsupport of trade climate policy andmeasures that contribute to thetransition to a net zero and lowgreenhouse gas emissions sustainablecircular economy.
Interjection
>> Yes.
Senator Matthew Canavan
>> Right. So we we can't do anything giventhe words in 18.2 we can't do anythingthat's not consistent with 18.63A.
