Senator Fatima Payman

Can you please provide an updated number of people seeking asylum in Australia on bridging visa of any kind that has an 8101? No work condition applied. And a breakdown of their countries of origin, gender, age, and their stage in the refugee status determination process.

Andrew Kiley

We'll have to take that on notice.

Senator Fatima Payman

Thank you. Can you also please provide the number of people currently residing in the Australian community who have applied for a protection visa, have received a decision affirming refusal of the protection visa by the ART, AAT, the Refugee Review Tribunal or Immigration Assessment Authority and remain in Australia?

Andrew Kiley

So, Senator at the moment there are just the data that Mr. Willard was touching on earlier. So there are currently 45,014 individuals who are still going through merits review at the administrative review tribunal. Beyond that, there are 18, 120 individuals at judicial review. And there are 47,715 individuals who have completed those processes and have not yet departed.

Senator Fatima Payman

Of those people, can you please provide the number who currently have proceedings on foot before the Federal Circuit and Family Court of Australia, Federal Court of Australia or High Court of Australia challenging a protection visa decision? And if we can have a breakdown by state and territory.

Andrew Kiley

So, Senator, those were the figures I just provided. So the 18,120 individuals, they are the ones who are currently seeking judicial review of their protection visa decision. The 47,000, there are no ongoing proceedings in relation to those individuals. We'll look to provide the state-by-state breakdown of those.

Senator Fatima Payman

Yep, that's what I'm after. Thank you. Just around Minister Burke's September Press Club, where he flagged the expansion of the immigration detention network across Australia. Is this the correct section for outcome to be asking questions around that?

Stephanie Foster

So the operations of the detention network are an outcome three issue. The policy around it you could ask here.

Senator Fatima Payman

So if I wanted to know the number of existing facilities that are currently being considered under the expansion and what actions are taken to commence that work? Like is would those be answerable in this outcome?

Stephanie Foster

Outcome three will have the officers who are actually responsible for that sector.

Senator Fatima Payman

Well we'll leave that for then. The rest seem to be all outcome three. Thank you. Thank you.

Senator Jana Stewart

Thank you, Senator Payman. Senator Blyth.
